Bylaw Enforcement

 

The Local Government Act and Community Charter provides local government with the authority to enforce regulatory bylaws within their jurisdictions.

 

The qathet Regional District has the authority to enforce zoning bylaws in Electoral Areas A, B, C and D.

 

Enforcement action is primarily initiated on a complaint-driven basis.

 

Bylaw Complaints

If you believe a zoning bylaw has been violated, please submit your complaint in writing to the Planning Department:

Complaints must include your name, address, phone number or email address, and a detailed description of the alleged bylaw violation and how it affects you, your property or your daily life.

 

Bylaw Investigation and Enforcement

Once a complaint is received, the Manager of Planning Services or their designate will conduct an investigation according to the policies and procedures set out in Policy 2.12 Bylaw Complaints and Enforcement.

 

The qathet Regional District strives to achieve voluntary compliance with its bylaws and regulations. However, if this goal cannot be met, then other enforcement actions may be taken to achieve compliance.

 

Privacy Notice:

All bylaw enforcement matters are considered confidential and every effort will be made to ensure confidentiality of the complainant. However, the Freedom of Information and Protection of Privacy Act, Section 15(1)(d), gives the Regional District discretion in identifying a confidential source of law enforcement information. A complainant may need to be identified if the complainant’s evidence is crucial in court to an enforcement action.
